The makers of the original “Night Of The Living Dead” have tried this without success.

It was a lot easier to raise $7,000 to oppose a trademark application for Night of the Living Dead.

So, how did things ultimately work out with the producer who wanted to sit on “Blood Waters of Dr. Z”, hoping the movie would be “rediscovered by new audiences”?

per the link, Joe Warren isn’t trying to take over the rights to the actual movie, he’s trying to trademark the phrase “Manos, the Hands of Fate”. Which is actually kind of more interesting in terms of defining what everybody can and cannot do when naming/referring to their products. Just say “Manos” as we usually do here at mst3kinfo? Would “Manos, Hands of Felt” be okay? Kind of interesting.

Well, if he’s successful in his copyright application, we could just be like Frank in the intro to the disc that replaced “Godzilla vs. Megalon”. We’ll just call it “mumblemumble, the Hands of mumblemumble”, so there.

Eh, this is actually where you stop having free market capitalism, which favors competition, versus crony capitalism, where the government decides who can compete in a market. Copyright was always meant to be limited in duration. Maybe not as limited as NotLD or Manos where they evidently forgot to include the notice. But still something only lasting for a decade or two, as opposed to what it is now, essentially forever.
Look at things like Dracula or Sherlock Holmes, things that have gone into public domain and thus generated countless products, creating jobs and making money for a wide swath of people. Did the original estate perhaps lose out? Maybe, maybe not. And in any event, they can still issue “Authorized” or “Official” versions to compete with other people.

Arguing over Manos in any manner is mind blowing.
Wish Harold was here to see it.
